Many people make the mistake of believing that if they have created a proper will, power of attorney and an advance directive for healthcare, they have satisfied their estate planning needs. These are the basic requirements, but they must be supplemented with appropriate retirement planning, if applicable, since a significant portion of many client’s assets, their tax deferred retirement accounts—traditional IRA’s, 401(k)’s and 403(b)’s—are not covered by their wills.

Aiming to Safeguard Retirement Investments, New Law Provides 2009 Hiatus from Required Distributions
The Worker, Retiree, and Employer Recovery Act of 2008 was signed into law in late December. This new law, among other things, suspends required minimum distributions (RMDs) from IRAs and qualified retirement plans for 2009. The intent is to provide relief to individuals who would otherwise be forced to liquidate retirement savings when many investments are at historic low points.

Matthew Nicodemo to Sit on Essex County Early Settlement Panel for Probate Matters
Archer attorney, Matthew Nicodemo, was recently invited and approved as a panelist to the Essex County Early Settlement Panel for Probate matters. Panelists assist the court by mediating contested probate matters, including estate, trust, and guardianship cases. The panel is comprised of experienced estate, trust, and elder law attorneys who are specially selected by the Chancery Judges in Essex County, New Jersey based on reputation, quality of work, and experience.
