On January 18, 2022, New Jersey Governor Phil Murphy signed into law an amendment to the statute of limitations applicable to construction defect claims arising in common interest properties such as community associations, condominiums, and co-ops. While the law still requires a claimant to file its lawsuit within six years of the time it knew or should have known of the defect (N.J.S.A. 2A:14-1), it does not start the clock on that six years until “an election is held and the owners comprise a majority of the board.”

Businesses Beware, Not all Waivers are Created Equal
New Jersey businesses which require waivers from their patrons may need to rethink their practices to ensure that those waivers are always enforceable. Earlier this month, the New Jersey Appellate Division in Gayles by Gayles v. Sky Zone Trampoline Park, held that businesses cannot rely on parents to sign waivers for other people’s children.

Fixing Defective Work on a Project May Result in Dismissal of Claims
Upon discovery of defective work, an owner's first inclination may be to immediately repair the work. An owner does so at his own risk, however, if he fails to provide adequate notice to the party allegedly responsible for the defective work. If the owner's repair work results in the destruction of evidence, the contractor or insurer may seek to have the owner's claim for defective work dismissed.

Archer’s Stan Gentile Represents Homeowners in Faulty Construction Litigation
Haddonfield, NJ (June 13, 2007) - In the case Beverly Artman and Meg Coley v. Joseph Daniel McCann General Contractors, et al. Superior Court of New Jersey, Law Division, Cape May County, (Docket No. CPM-L-674-06), work was performed by a home improvement contractor on a Wildwood Crest, NJ vacation home with allegations of faulty workmanship and construction. The homeowners had extensive work performed on their shore house, including the raising of the existing home and building of an additional first floor with new rooms, bathrooms, doors, windows, stairs, HVAC, electrical, etc.
