Two Recent Decisions May Limit the Effectiveness of “Submarine Patents”
In December 1994, Congress passed a law enacting the General Agreement on Tariffs and Trade (“GATT”), extending the timespan of the protection offered by patents from 17 years after it was issued to 20 years, but it keyed the start time to the filing of the patent application rather than the issuance of the patent. Although the new law was passed in late 1994, it did not go into effect until June 8, 1995, and it only applied to patent applications filed on or after that date.

Third Circuit Clarifies When a Case "Arises Under" Federal Patent Law
In most circumstances, if you want to appeal a decision after the end of a case in federal district court in New Jersey, your appeal would be heard in the Third Circuit Court of Appeals in Philadelphia, Pennsylvania. However, Congress has the power to give other courts exclusive jurisdiction for certain types of cases, and one such instance is appeals in patent cases.

John Connell Appointed to NJ Supreme Court Professional Responsibility Rules Committee
Partner, John C. Connell, has been appointed to the New Jersey Supreme Court Professional Responsibility Rules Committee for the remaining portion of a three-year term that expires August 31, 2027. The Committee is charged with two tasks: to review and report on referrals from the court that relate to the Rules of Professionals Conduct, and also to entertain and act on issues raised by the Bench, the Bar, the Office of Attorney Ethics, or a member of the Committee.

This revised treatise is now available from Gann Law in print or e-book editions.
